Terms of Use

The rules for using CapyBrian, Gold and group chat.

Agreement

These terms are between you and Max Nurney ("we"). By creating an account or using CapyBrian you agree to them and to the Privacy Policy and Community Rules. They apply from 2 November 2026. You must be at least 13 years old.

Your account

• Give accurate information and keep your sign-in private.
• You are responsible for what happens under your account.
• You can delete your account at any time in Settings.

Gold and purchases

• Gold is a virtual item that works only inside CapyBrian. It has no cash value, cannot be exchanged for money, and cannot be transferred to another person.
• You can earn Gold by playing and, where the app offers it, buy Gold with the App Store. Payment, receipts and refunds are handled by Apple: to ask for a refund, use Apple's refund request process. We do not refund Gold automatically.
• Your Gold belongs to your account. If your account is deleted, any remaining Gold is lost.
• We may limit how much Gold can be bought in a period, to protect you from mistakes and overspending.
• Gold purchases are one-off purchases. There is no subscription.

Group chat and other people

You can chat with the people in your group. Follow the Community Rules: there is no place on CapyBrian for objectionable content or abusive behaviour, and we act on it. We filter some messages automatically, you can report a message and block anyone, and we may remove content or suspend people who break the rules. We do not promise that every message is reviewed before it is seen.

If Brian's AI replies are switched on in your group (they need every member to agree), messages you write in that chat may be sent to our AI provider to produce them. Brian's AI replies can be wrong or odd; do not rely on them.

What we ask of you

• Do not attack, copy or reverse-engineer the service, or try to get Gold or items you did not earn or pay for.
• Do not use CapyBrian to harass, deceive or harm others, or to break the law.

The service

We work to keep CapyBrian running and may change, pause or end features. Brian and the artwork belong to us or our licensors; you may use the app for your own personal use only. We provide the app "as is". Nothing in these terms limits any right you have by law that cannot be limited, or our responsibility for things the law does not let us exclude.

Ending

We may suspend or close an account that breaks these terms. If we do so for a reason other than a breach, we will tell you and deal fairly with any Gold you bought.

Law and contact
